REGULATORY FUNCTION OF STATE POWER

Abstract


The article is devoted to clarifying the role of the regulatory function of state power. Within the framework of the conducted research, it was established that the regulatory function is of a complex nature and covers all key areas of public life, including the economic, social, environmental, legal, informational and political spheres. Its content consists in establishing legal norms, organizing their implementation, as well as monitoring and protecting law and order. Considerable attention was paid to the interaction of the three branches of power in the process of implementing the regulatory function. It is the coordination of their activities that ensures the effective regulation of public relations, the prevention of conflicts of interest and the stable development of the legal system. Imperfection of interaction between the branches of power can lead to legal conflicts, duplication of regulatory mechanisms or, conversely, gaps in legal regulation. Therefore, it is especially important to adhere to the principle of separation of powers, enshrined in the constitutional acts of democratic states, which allows avoiding the concentration of power and guaranteeing balance in the process of making and implementing regulatory decisions. The work also outlined the current prospects for the development of the regulatory function of state power. In particular, trends towards the digitalization of state administration, the introduction of electronic regulatory instruments, the modernization of the regulatory and legal framework taking into account European standards, as well as the strengthening of the human rights aspect in the process of regulating public relations were identified.
