JUSTICE AS A GUIDE OF THE STATE: THE MECHANISM FOR CHOOSING A FORMULA IN THE AGE OF DIGITALIZATION

Abstract
The article notes that the topic of justice has become increasingly relevant in recent years, especially in Ukraine, due to the Russian-Ukrainian war. Attention is drawn to the lack of works that provide recommendations on the practical application of the principle of justice. The approaches of researchers who understand justice differently are presented: as initial conditions; as an opportunity to participate in decision-making processes; as a result. It is noted that different interpretations of justice complicate its practical implementation.
Based on an analysis of theories of justice and their criticism, it is concluded that justice is an important guideline for the formation, development, and transformation of the state and society. It is determined that the first step towards the practical establishment of justice in the country is to choose a formula that best meets the expectations of a particular society. Attention is drawn to the key role of the state in providing opportunities for citizens in accordance with the chosen formula. Two types of justice are identified and characterized – internal and external, which are in particular need of improvement in Ukraine. It is emphasized that for volunteers, restoring justice by helping citizens in need is a personal desire and voluntary agreement, while for public authorities it is a duty.
It has been proven that the choice of the formula of justice should be made by public authorities in close cooperation with civil society. It has been proven that political decisions and legal norms will be better enforced, mostly voluntarily, if society supports the chosen interpretation of justice. Based on the results of an international ranking, the level of digitalization in Ukraine has been shown. Given our country's leading position in the development of digital technologies in the public sector, it has been proposed to create a national platform called "Justice.ua", whose goal will be to choose a formula and develop a concept and model of justice that are appropriate for Ukrainian society.
