ADVANTAGES AND DIFFICULTIES OF IMPLEMENTING MEDIATION PRACTICES INTO PUBLIC POLICY IN CONTEMPORARY UKRAINE

Abstract


The article reveals the possibilities of mediation for increasing the effectiveness of public policy in modern Ukraine. The Law of Ukraine "On Mediation", the State Standard of Social Service of Mediation are analyzed to establish the mediality of conflicts (disputes) in the field of public policy. In particular, it is found that the mediality of conflicts (disputes) in the field of public policy will mean compliance with specific criteria (conditions) under which the effectiveness and / or possibility of the mediation procedure is ensured.
The advantages and disadvantages of mediation in the public policy of modern Ukraine are determined. In particular, the advantages of mediation in public policy include: improving communication; strengthening cooperation; improving problem solving; making more creative decisions; reducing conflicts; saving money and other resources. The obstacles to the implementation of mediation in the public policy of modern Ukraine include: the presence of diverse interests of stakeholders, which leads to conflicting priorities, and this can complicate mediation efforts; lack of trust between stakeholders; the complexity of public policy issues, which can lead to misunderstandings or an imbalance of power; the volatility of the political environment, which makes it difficult to create a stable environment for negotiations; the presence of cultural and language barriers; insufficient awareness and understanding of mediation processes among politicians and the public, which increases resistance to the use of mediation; limited resources.
It has been proven that political mediation is of great importance for establishing a stable public policy regime and maintaining it at the proper functional level, which is designed to facilitate interaction between stakeholders. It is emphasized that it is thanks to political mediation that it becomes possible to achieve mutual understanding on the basis of effective communication between the parties to the conflict, which ultimately contributes to the development of a policy designed to meet the needs of the community and individual social groups. This ensures transparency in the adoption of public and political decisions, strengthens trust in the authorities and their support from the population, which is crucial for the longevity of public policy in modern Ukraine.
